Note: The Procurement Mode shall be Negotiated Procurement - Section 35.2 Emergency Cases of Republic Act No. 12009, not Negotiated Procurement - Two Failed Biddings (Section 53.1) of RA 9184.
Considering that the PhilGEPS system has not yet been updated to reflect the modes of procurement under Republic Act No. 12009, the procurement shall nonetheless be conducted through Negotiated Procurement - Section 35.2 Emergency Cases, as provided under the Implementing Rules and Regulations (IRR) of RA No. 12009.
Pursuant to Section 35.2 (Emergency Cases), paragraph (c)(ii) of the Implementing Rules and Regulations of Republic Act No. 12009, this mode of procurement shall be applied to restore vital public services, infrastructure facilities, and other public utilities.
