In compliance with Section 35.1.1 (a) (b) of the Implementing Rules and Regulations of RA 12009 or the New Government Procurement Act, where there have been (2) failures of bidding in the case of Competitive Bidding, Limited Source Bidding or Competitive Dialogue for the second time, as provided for in Section 64 of the same IRR, to wit:

Thereafter, the BAC, based on its findings, as assisted by its Secretariat, TWG and End-User or Implementing Unit may revise and agree on the technical, legal, and financial eligibility requirements and technical specifications or terms of reference, and if necessary, adjust the ABC, subject to the required approvals. xxx
